Is the Constitution a kind of law? |

Our Constitution is India's basic legal document. It was prepared by a Constituent Assembly consisting of elected members and it came into force on 26th January 1950. The Constitution is a people's document – it has been made and adopted by the people of India (their elected representatives, actually) as the basis of the legal system and governance. The constitution also serves as a yard stick against which all other laws are tested. Therefore any law made by the Parliament and State legislatures should not go against the provisions of the Constitution. Otherwise, the law can be struck down by the High Courts/Supreme Court. The Constitution sets out the basic structure of governance for the country, with regard to law making, administration and the judiciary at the state and central levels. It gives all citizens certain fundamental rights, including the right to equality and the right to life to all persons. It also lists our fundamental duties and the desirable goals for the government. |
