Domestic Violence |

In India, domestic violence falls under the category of cruelty. Cruelty is an offence in Criminal Law under s498A,of the Indian Penal Code which is applicable to women. Women also have such special rights against domestic violence and ill-treatment under international law like in the international convention on elimination of discrimination against women. However children are not specifically mentioned in criminal law, but can complain under the general criminal offence of hurt or grievous hurt. Children also have special rights against violence and ill-treatment under international law that the government of India is under a duty to follow. This is under the Convention on the Rights of the Child Various women's organizations are making efforts to introduce a Domestic Violence Bill which would cover the effects on women and children, issues of maintenance and appoint special officers to ensure complaint procedures and prevention of domestic violence. There are also attempts to ensure that there is special recognition of domestic violence and sexual abuse of children in law, which does not exist right now.
